nuisance. In the future, there may be a difficult balancing act between an occupier’s right to
do as he pleases on his own land and his neighbour’s right to enjoy his land to the fullest
extent.
It remains to be seen whether the courts will be able to develop the law of privacy as fully
as other jurisdictions such as the United States. The courts will be mindful of some of the
concerns highlighted by the Calcutt Report and in recent cases before the courts. The right
to assert privacy is also complicated by the need to consider other recently introduced
legislation such as the RIPA. Only time will tell whether the embryonic right to privacy
develops fully or is rendered subservient to other, more politically charged, legislation.
