1. In consideration of your undertaking in paragraph 2 I/we warrant confirm and agree as
follows:
EITHER
1.1 By virtue of Clause [insert] of the will of the Author dated [date] all rights of
copyright in the Work and moral rights conferred by Part I Chapter IV of the
Copyright, Designs and Patents Act 1988 (the ‘Act’) were by testamentary
disposition bequeathed to me/us.
OR
1.1 The will of the Author made no provisions for the testamentary disposition of the
moral rights conferred by Part I Chapter IV of the Copyright, Designs and Patents Act
1988 (the ‘Act’) but pursuant to Clause [insert] of the will of the Author dated [date]
all rights of copyright in the Work were by testamentary disposition bequeathed to
me/us and pursuant to the provisions of Section 95(1)(b) of the Act all moral rights
in the Work are vested in me/us.
OR

1.1 The Author died intestate and pursuant to Section 95(1)(c) of the Copyright, Designs
and Patents Act 1988 (the ‘Act’) all moral rights conferred by Part I Chapter IV of
the Act are exercisable by me/us as the Personal Representative(s) of the Author
pursuant to [specify method of appointment] which vested in me/us all rights of
copyright in the Work.
1.2 I/we irrevocably and unconditionally waive all rights to which I/we am/are entitled
pursuant to Sections 77, 80 and 85 of the Act and any other moral rights provided for
under the laws now or in future in force in any part of the world in respect of the
publication and expectation by you your successors assignees and licensees of the
Work I/we now assign to you and your successors assignees and licensees absolutely
the whole of the reversionary interests in the copyright in the Work throughout the
world for the full period of copyright protection including all renewals revivals
reversions and extensions now or in the future existing under the laws in force in any
part of the world and warrant that I/we are the sole absolute unencumbered legal and
beneficial owner(s) of the same.
