418 CHAPTER 1 Introduction to UK DCR Regulations and the Duties
The following offshore installation safety legislation requires verification to be
undertaken:
• The Offshore Installations (Offshore Safety Directive) (Safety Case, etc.)
Regulations 2015 (SCR 2015),
• The Offshore Installation and Wells (Design and Construction, etc.) Regulations
1996 (DCR),
• SI 1995 No. 743 the Offshore Installations (Prevention of Fire and Explosion,
and Emergency Response) Regulations 1995 (PFEER).
The following offshore installation legislation is also applicable to parts of this
document, supplemented by respective guidance and approved codes of practice:
• SI 1995 No. 738 The Offshore Installations and Pipeline Works (Management
and Administration) Regulations (MAR),
• SI 1992 No. 2392 Provision and Use of Work Equipment Regulations
(PUWER),
• SI 1996 No. 825 Pipeline Safety Regulations (PSR).
DUTY HOLDER
One of the duties of the duty holder is defined as follows:
‘The duty holder shall ensure that an installation at all times possesses such
integrity as is reasonably practicable’.
This general duty is expanded upon throughout the text of the regulations.
In summary, the duty holder is responsible for the determination of all risks
associated with all phases of the lifecycle of an installation, and the demonstra-
tion that those risks are reduced to ALARP through implemented measures for
safety management. An integral part of that risk management is the development
and operation of the SCR Verification Scheme and the PFEER Written Scheme,
including the selection of ICP. The duty holder must record the ICP selection
process.
The duty holder must also periodically review the Verification Scheme and,
where necessary, revise or replace it, in consultation with the ICP (SCR Regulation
15(3)).
INDEPENDENT AND COMPETENT PERSON (ICP)
As a minimum the duty holder is required to appoint an ICP to:
• Comment on the record of SECEs drawn up by the duty holder (SCR
Regulation 15(1)).
• Draw up a Verification Scheme, or act in a consultative capacity in the drawing
up of the scheme by the duty holder (SCR Regulation 15 (1)).
