Is It Correct?

iving my deposition proved to be one of the most
depressing days of my life. Like Dorothy waking
Gup in the Land of Oz, I realized I wasn’t in Kansas
anymore.
My husband and I had bought a piece of property on
which the previous owner hadn’t disclosed that it was lo-
cated in a creek floodway (meaning it could never be re-
claimed and built on). Neither did the Realtor® represent-
ing both of us, the buyer and seller in the transaction,
investigate the issue as we had asked her to do. So when we
discovered we’d paid a king’s ransom for practically worth-
less land, we were forced to file a lawsuit against the
landowner and Realtor for their nondisclosure.
Here’s what I expected at the deposition from the owner
and Realtor: a lot of “he said/she said.” Or, “When you
asked about X, I thought you meant Y.” Or, “When I said
Z, what I really meant was B.” And a plethora of, “I don’t
